1. Terms of Service

Welcome to MusicZambia.com! By accessing or using MusicZambia.com, you agree to be bound by these Terms. If you do not agree, please do not use our website.

1.1 About The Platform

MusicZambia.com is a Zambian music streaming and distribution platform that allows artists around Zambia to upload both Audio and Video content themselves using a smartphone, tablet or computer with internet.

1.2 Eligibility & Accounts

1. You must be at least 18 years old or have parental consent.
2. To upload, you must Register and Create an Artist Account.
3. All Artist Accounts must be verified by MusicZambia Admin. Click "Verify My Account" on your Artist Dashboard to request activation.
4. You are responsible for maintaining the confidentiality of your login details.

1.3 Upload Rules — Launch Offer

1. Uploading of BOTH Audio and Video is FREE of Charge.
2. For the launch month of October 2026, each verified Artist is allowed a maximum of 20 Audio Songs and 20 Music Videos.
3. Audio format: MP3, Max 25600 Kilobytes (25 MB). Video format: MP4, Max 200MB.
4. Cover art must be clear, not blurry, minimum 1000x1000px. No pornographic images.

1.4 Content Ownership & License

You retain 100% ownership of your content. By uploading to MusicZambia.com, you grant us a non-exclusive, worldwide, royalty-free license to host, stream, promote, display, and distribute your content on our website, mobile version, and our official social media pages (Facebook, TikTok, WhatsApp Channel) for promotional purposes.

Royalties and Distribution

1. Artists get 50% of Revenue from their total songs downloaded.
2. Artists get 80% of all donations and gifts they get from the platform.
3. Artists get 70% from users that pay premium subscription.

1.5 Prohibited Content

You agree NOT to upload:

• Pirated or stolen music
• Content you do not own or have no permission for
• Hate speech, tribalism, pornography, graphic violence
• Content that infringes copyright of another Zambian or international artist

Violation will lead to immediate content removal and permanent account ban.

1.6 Future Monetization

MusicZambia.com may introduce premium downloads, subscriptions, and advertising revenue sharing in the future. Any revenue share percentages and payment via MTN Mobile Money, Airtel Money or Bank Transfer will be communicated via your Artist Dashboard and Email.

1.7 Termination

We reserve the right to suspend or terminate unverified accounts, inactive accounts, or accounts violating these terms without prior notice.

1.8 Disclaimer

The website is provided "as is". We do not guarantee uninterrupted service.

1.9 Governing Law

These Terms are governed by the Laws of the Republic of Zambia. Any disputes shall be settled in the courts of Kitwe, Zambia.

2. Upload Agreement

By clicking "Upload", "Publish", or "Submit" on MusicZambia.com, you enter into this legally binding Upload Agreement.

I, the Artist / Uploader, declare and agree that:

2.1 Ownership

The content I am uploading is my original work, or I have full written permission from the producer/owner to upload it. I am not uploading another artist's work.

2.2 License

I grant MusicZambia.com a free, non-exclusive license to store, stream, transcode, create thumbnails, and promote my content. I keep all ownership and can upload the same content to Boomplay, Zedist, YouTube and other platforms.

2.3 Free Upload

I understand uploading is FREE. I will not be charged. I also understand I will not be automatically paid just for uploading unless my music qualifies for the future Monetization Program.

2.4 Limit

I understand the current limit is 20 Audio and 20 Video uploads per Artist for this month.

2.5 Quality & Responsibility

I will upload high quality audio and proper cover art. I am fully responsible for any copyright claim arising from my upload. MusicZambia.com will not be liable.

2.6 Verification

I understand my content will only go LIVE after my Artist Account is verified by MusicZambia Admin after I click "Verify My Account".

2.7 Deletion

I can delete my songs anytime from my Artist Dashboard. Deletion will remove the song from public view within 24 hours.

If you agree, click "I Agree to Upload Agreement" before uploading.

3. Takedown Policy (DMCA & Copyright Policy)

MusicZambia.com respects intellectual property rights and complies with the Copyright and Performance Rights Act of Zambia.

3.1 Reporting Infringement

If you believe your work was uploaded without permission, send a Takedown Request to: musiczambiasupport@gmail.com

Your email MUST include:

1. Your full legal name, phone number, email
2. Proof you are the owner (NRC, studio receipt, original YouTube/Facebook link, producer contract)
3. The URL link of the infringing song on MusicZambia.com
4. The URL of your original work
5. This statement: "I have a good faith belief that the use of the material is not authorized by the copyright owner and this complaint is accurate"
6. Your signature (typed name)

Subject: TAKEDOWN REQUEST - [Song Title]

3.2 Our Action

We will review within 24-48 hours. If valid, we will REMOVE or DISABLE access to the infringing content immediately and notify the uploader.

3.3 Repeat Infringers

Artists with 3 valid takedown complaints will have their Artist Account permanently banned.

3.4 Counter-Notice

If your content was removed by mistake, send a Counter-Notice to musiczambiasupport@gmail.com with proof of ownership (project files, WAV, producer agreement). If valid, we will restore within 72 hours.

4. Privacy Policy

Effective Date: 07th October, 2026

4.1 Information We Collect

When you register as an Artist on MusicZambia.com, we collect:

• Personal: Stage Name, Real Name, Email Address, Phone Number, Town/City (e.g. Kitwe, Lusaka)
• Profile: Profile Photo, Bio
• Content: Your Audio Files, Video Files, Cover Arts, Song Titles
• Technical: IP Address, Device Type, Browser Type, Login Time (for security)

4.2 How We Use It

• To verify your Artist Account and give you upload access
• To display your music publicly
• To contact you about your music, verification, and promotions
• To secure the website and prevent fraud
• To process future earnings via MTN Mobile Money / Airtel Money

We will NEVER sell your data to third parties.

4.3 Cookies

We use cookies to keep you logged in and to count plays/downloads. You can turn off cookies in browser settings.

4.4 Public Information

After verification, your Stage Name, Profile Photo, Bio, and Music are PUBLIC and visible to anyone on the internet.

4.5 Data Retention & Deletion

We keep your data while your account is active. You can request to delete your account and all data by emailing musiczambiasupport@gmail.com.

4.6 WhatsApp Group Privacy

If you join MusicZambia WhatsApp Group, your phone number is visible to other group members. Do not share sensitive information there.

4.7 Your Rights Under Zambia Data Protection Act No. 3 of 2021

You have the right to access, correct, delete, or withdraw consent for your personal data.

4.8 Security

We use reasonable security measures but no system is 100% secure. Use a strong password.

4.9 Updates

We may update this policy. Changes will be posted on this page with a new effective date.
